Data Protection Directive 95/46/EC


We were recently asked how Wave's WiFi Ad Platform would work in terms of the various changes to privacy legislation across the EU. 
To clarify, the European Union has introduced a Data Protection Directive that regulates the processing of personal data within the European Union. It is an important component of EU privacy and human rights law. On 25 January 2012, the European Commission unveiled a draft European Data Protection Regulation that will supersede the Data Protection Directive. The US-EU Safe Harbor is a streamlined process for US companies to comply with the EU Directive 95/46/EC on the protection of personal data.
In all honesty, implement Data Protection Directive 95/46/EC takes some effort. However it's a worthwhile due diligence process which supports qualitative risk management of our users privacy and it does it much better than ISO's 22307, 21547 and 27002. 

We also fully applaud the introduction of the streamlined US-EU Safe Harbor certification programme and the draft Data Protection Directive put forward in January this year. The 7 principles in these documents will be a great addition in all our companies, helping us to reassure our users’ that their data is evidently in the safest hands possible; their own. This is done by adhering to the following principles; 
  1. Notice—data subjects should be given notice when their data is being collected;
  2. Purpose—data should only be used for the purpose stated and not for any other purposes;
  3. Consent—data should not be disclosed without the data subject’s consent;
  4. Security—collected data should be kept secure from any potential abuses;
  5. Disclosure—data subjects should be informed as to who is collecting their data;
  6. Access—data subjects should be allowed to access their data and make corrections to any inaccurate data; and
  7. Accountability—data subjects should have a method available to them to hold data collectors accountable for following the above principles
Our company has recently scheduled a solution that’ll give our users full visibility and authority on the data we hold. This development will be operational from day one. Until further notice we’ll also be keeping the conventional WiFi Access registration option, which gives our WiFi infrastructure users a choice to use social profile for access. 

Unlike most major internet advertising firms our asset is trust, not data.
